The DOL requires a Fidelity Bond for every
qualified retirement plan. However, there is some
confusion over the type of bond that is acceptable for
ERISA compliance. The regulations are very clear – an
Employee Dishonesty Bond does not fulfill the
requirements for compliance. Neither does Errors and
Omissions insurance. According to DOL regulation
29 CFR 2580.412-21, it is the responsibility of the
plan administrator to assure, each year, that the plan
has an ERISA Fidelity Bond issued by an insurance
company that is Treasury listed. The list of
Treasury-Listed companies changes every year, as the
Certificates of Authority which are issued by the
Secretary of the Treasury expire each April 30.
Additions and removal are listed in the Federal Register
throughout the year.

PS - The IRS set the 2004 Standard Mileage Rate at 37.5 cents per mile, 1.5 cents (per mile higher than the 2003 rate), in Revenue Procedure 2003-76. This rate becomes effective Jan. 1, 2004. The IRS also set a standard mileage reimbursement rate for 2004 of 14 cents per mile for using an automobile to obtain medical care described in Section 213, or as part of a move for which the expenses are deductible under Section 217. This is two cents per mile higher than the 2003 rate.
